These terms and conditions (“Terms”) apply to your use of the Medimap Symptom Checker tool (“the Tool”) provided by Medimap.ca (“Medimap”) through its website, mobile application, or any other platform where the Tool is made available. By using the Tool, you agree to these Terms.
The Tool is designed to provide general health information and is not intended to replace professional medical advice, diagnosis, or treatment. The Tool is not a substitute for seeking medical advice from a qualified healthcare provider, and you should always seek the advice of your healthcare provider with any questions or concerns you may have regarding your health. Medimap does not endorse or guarantee the accuracy or completeness of any information provided by the Tool.
The Tool and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by Medimap or its licensors and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Limitations of Liability
In no event shall Medimap, its affiliates, or their respective officers, directors, employees, agents, licensors, or suppliers be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of or inability to use the Tool or the information provided by the Tool. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Medimap has been advised of the possibility of such damage.
You agree to indemnify and hold harmless Medimap, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your use of the Tool.
Modifications to Terms and Tool
Medimap reserves the right, in its sole discretion, to modify or replace these Terms at any time. If a revision is material, Medimap will provide notice on its website. Your continued use of the Tool following the posting of any changes to the Terms constitutes acceptance of those changes. Medimap may also update or modify the Tool at any time without prior notice.
Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflicts of law provisions. Any dispute arising out of or relating to these Terms or the Tool shall be submitted to the exclusive jurisdiction of the courts of the Province of British Columbia.
